ThreeTone Terms of Service

1. Eligibility

• You must be 18 years or older to use the Services.
• If you are using the Services on behalf of a company, you represent that you are authorized to bind that company to these Terms.
• You are responsible for ensuring your team complies with these Terms.

2. The Services

ThreeTone provides a unified voice and AI automation platform, including:

• Real-time voice agents
• Phone numbers and outbound calling
• Agent memory and conversation history
• Website-embedded or API-driven voice agents
• Call routing, transcription, and other communication tools

ThreeTone may modify, add, or remove features at any time.

3. Accounts and Security

• You must create an account to use most Services.
• You are responsible for maintaining the confidentiality of your account and API keys.
• You must notify us immediately of unauthorized access or misuse.
• We may suspend or terminate your account for violations of these Terms or harmful activity.

4. Subscriptions, Billing & Payments

4.1 Plans

ThreeTone offers:

• Monthly subscriptions
• Yearly subscriptions
• One-time purchases (e.g., phone numbers)

4.2 Auto-renewal

All subscriptions automatically renew for the same term unless cancelled before renewal.

4.3 Free Tier

Free plans are allowed for non-commercial use only.

4.4 Refunds

Payments are non-refundable, except in limited cases at our sole discretion.

4.5 Price changes

We may change pricing at any time. Existing subscriptions renew at the new price unless you cancel.

5. User Content, Call Data & AI Output

5.1 Inputs

You may provide text, audio, call recordings, numbers, and other content ("Input").

5.2 Outputs

• We provide AI-generated audio, text, and actions ("Output").
• You own all Output, subject to these Terms.

5.3 License for service operation

To operate and improve the platform, you grant ThreeTone a license to:

• Process your Input
• Store and use conversation transcripts
• Maintain agent memory you enable
• Process audio for real-time calls

This license is non-exclusive, worldwide, royalty-free and exists only to provide and improve the Services.

5.4 Sensitive Information

Agents may receive sensitive information only if you choose to collect it. ThreeTone is not responsible for how you choose to handle such data.

5.5 No Voice Cloning

ThreeTone does not offer voice cloning. Uploading or using recordings of minors for cloning or impersonation is prohibited.

6. Prohibited Use

You may not use the Services for:

• Spam, scam, fraud, or deceptive calls
• Impersonation without consent
• Harassment, threats, or hateful behavior
• Political campaigning or persuasion
• Emergency calling
• Collection of protected health information (PHI)
• Any illegal, harmful, or abusive activity
• Attempts to reverse engineer or misuse our platform

We may suspend or terminate your account for violations.

7. Outbound Calling

Outbound calling is allowed, subject to:

• Applicable telecom laws
• No illegal or unauthorized activities
• No mass unsolicited marketing campaigns

ThreeTone may block suspicious activity automatically.

8. Beta Features

Certain features may be labeled "Beta."

Beta features:

• May contain bugs
• May change or be removed
• Are provided "as is"
• Are not guaranteed to be stable

Using Beta features is at your own risk.

9. Third-Party Integrations

Our platform may integrate with external tools (CRM, websites, etc.). You are responsible for any data you choose to send to these services.

10. Termination

We may suspend or terminate access if:

• You violate these Terms
• You misuse the platform
• We detect fraud or abuse
• Required by law

You may delete your account at any time.

11. Disclaimers

The Services are provided "as is". We do not guarantee:

• Uninterrupted operation
• Error-free performance
• Accuracy of AI-generated content
• That calls will always connect or meet your expectations

You use the Services at your own risk.

12. Limitation of Liability

To the fullest extent permitted by law:

ThreeTone's total liability for any claim is limited to the lesser of:

• The total fees you paid us in the previous 12 months, or
• INR 5,000

We are not liable for:

• Lost profits
• Business losses
• Loss of data
• Indirect, incidental, or consequential damages

This clause survives termination.

13. Governing Law & Disputes

• These Terms are governed by the laws of India.
• Courts in Bengaluru, Karnataka have exclusive jurisdiction over any disputes.

14. Modifications

We may update these Terms. The "Last Updated" date reflects the latest version. Continued use of the Services constitutes acceptance of updated Terms.
